A former employee had expressed interest to return to our employment. The employee had previously worked in the UK for over a year but had resigned in May 2020 & shortly after, returned to Romania. We have offered him employment to start on 22 June 2021 subject to him following government guidelines - applying for settlement status & quarantine upon arrival in the UK. As employers cannot ask for an employee to show their settlement status before 30 June 2021, the employee can prove his right to work with his EU ID card and/or passport. Is this correct? How will this affect the employer as we are aware the employee is arriving after 31 December 2020. Also in this case, does the employer have to apply to be a sponsor to hire this employee as he had arrived in the UK after 31 December 2020? Will his prior residency affect this - in that he was living in the UK before this date?
