Hi! My query is specific. I am buying a house in the UK valued at £275,000 with my wife. We also own a property in France valued at £30,000. Therefore, it is below £40,000. The guidance is clear in stating this means higher rate stamp duty does NOT apply. However, what is not clear in the guidance is how to complete the SDLT1 form appropriately. Should Q1 simply be answered as Code 1 in this case? Therefore HMRC see the French property as having no relevance. Or should Q1 be answered with Code 4? If so, there does not appear to be an opportunity to mark the property as valued below £40,000, thus you would be incorrectly taxed at higher rate. I have been very specific and hope an answer can be provided for the correct course of action as it's incredibly important to get right. Thank you.
