termination of contract

If an employer communicates with you that there is availability for you anymore on say 25.1.23. However, on the P45 states that the end of the contract was 1/1/23 but the individual was still working/ sending in their availability to work. Is this false? as there was no communication of the termination of contract till 23rd and the individual was still under there the contract the employment.
