I am tax resident in France. In the second half of March, I will be receiving the first payment from an annuity purchased from a UK provider. Here is my question: Can I send the France Individual DT to HMRC now? Or do I need to wait until I have received the first annuity payment? Thanking you in advance.

Hi,

You will need to wait until you are in receipt of your annuity and then complete the DT individual UK/France, which you can find here:

Double Taxation: UK-France (SI 2009 Number 226) (Form France-Individual)

You should complete the form and send it to the French tax authorities for validation.  

The French authorities will sign and stamp the form to confirm that you are resident in France for tax purposes and your annuity is taxable there. They will return the form to you, at which point you send it to HMRC at the address on the form.

Once the validated form is processed, we can repay any tax deducted by the annuity provider.

Hello I am also a tax resident of France and I submitted my S12009 Number 226 on 5th April 2023 I have not received any correspondence since. How long should it take to process my claim? Many thanks

I think I need to fill in this form because I am resident in France and I receive bank account interest in the UK. It seems like I need to fill in the form and then have it stamped by my local tax office. If this is correct, they will need the form in French. I can only find it in English - do I just provide a translated copy myself or is there an official french version somewhere?

Hello I submitted my S12009 on 4th April 2023 and you suggested I would receive a reply by 5th June. Today is the 14th and still no reply Is there any way that I can monitor the progress of my claim Many thanks

Hello I am in a similar situation. I posted my completed DT individual UK/France on March 17. My Government Gateway account shows it as being “received” on March 31. However, I have heard nothing further since Please can you advise how long it is taking to process the form and apply a nil tax code? Thanking you in advance.

Hi I am in a similar situation to GAV above I posted my completed DT individual UK/Portugal in February. My Government Gateway account shows form as being received on February 27. HMRC site says I should have received reply 1 May. Nothing received so far (6 weeks overdue) Would you advise how long it is taking to process DT Individual form and apply a NT tax code please?

Does anyone know if we can submit the Form DT Individual to HMRC, online? or is the only way to submit this form to HMRC by post? Many thanks.

I submitted my S12909 on the 5th April 2023 and called the help line +44 13 5535 9022 on 18th July. HMRC has my form but 16 days later, still no letter of confirmation of nil tax code..

Hello I’m very happy to say that I have finally received confirmation of nil tax on my pension The letter states « you do not have to pay tax on the pension included in your claim from 7 MARCH 2023 » It also says that « I need to claim a repayment after the end of the current tax year » The 7th March 2023 was in the last tax year. Am I able to make a reclaim now or do I have to wait until April 2024? Many thanks

You can claim now. You can do this by telephone - +44 13 5535 9022.
There is an automatic run done by the PAYE system but you may want to call.
