Application to pay Class 2 from abroad - still not actioned

My son sent in his application form CF83 to apply to pay voluntary Class 2 contributions from abroad. He also wants to pay for years 2013 onwards. This form was received by HMRC around 9th September 2022 but still hasn't been dealt with. He is concerned about running out of time to pay 2013 to 2016 as these will drop off from April 2023. When will the appropriate department get to his application and should it be after 6th April will he still be allowed to buy those years as the delay isn't his fault?

Hi jem16, A similar question was answered the other day by HMRC Admin 2 in the thread "Paid Voluntary NI contributions - How long is updating of the online NI records taking?". They said, "We can consider payment of voluntary National Insurance contributions as far back as 2006 to 2007 tax year but your application form would need to be received by us before 5 April 2023 to be considered that far back. If we receive the application form after 6 April 2023 we can consider payment of voluntary National Insurance contributions from 2017 to 2018 onwards." Thank you Gary. Form was received by HMRC on 14th September and he certainly ticked the box requesting information in filling gaps in previous years. Hopefully this is considered enough as an application to pay for those years but he really doesn't want to miss that deadline. Perhaps HMRC Admin can tell me where they're up to on this and if he definitely will be allowed to pay for those years?

Your son will still be allowed to pay the years and rates they have applied to pay if they meet all conditions to pay while abroad. He will get a extended time limit of up to 8 weeks to make his payment.

This is referred to in the business as time does not run provision and applies to the period between the customer asking a question and being given an answer. This means that the time taken to produce an answer is ignored.

Thank you HMRC Admin 19 - that is reassuring. Would you be able to say where they are up at the moment? Are they close to looking at his form received 14th September 2022?

Non EU:  17 August 2022

Thank you Admin 20. He's in a Non EU country. Rather surprised at that answer though as he phoned on 23rd January and was told they were dealing with post from 30th August 2022.

Hi On 28/3/23 I became aware that applications had to be received by 5/4/23. This is contrary to the advice I received by phone to HMRC on 21/3/23. I can provide further details of my call My application to pay voluntary NI contributions was post on 28/3/23 using Royal Mail’s ‘next day guaranteed delivery service’. However I have been logging on daily to their tracking site and my letter containing my application is still showing up as situated at their Chelmsford mailing centre. I have done all in my power to ensure my application arrives at HMRC. Will HMRC take this into account if my application is not received by 5/4/23?

We can confirm that the deadline of 5 April 2023 has been extended to 31 July 2023. Your application will need to be received at HMRC by 31 July 2023 for earlier years (2006-2007 to 2016-2017) to be included in your shortfall. 

You will need to contact Royal Mail if your application is not shown as being delivered to HMRC.

hi, I've sent in the application for Class 2. I understand it will take time for the application to be processed but when it is how are we informed that it has been accepted and then how do we make payments for previous years at Class 2 cost? regards, Colum.

We are sorry for the delay in responding to your application to pay Class2 Voluntary NICs whilst you are abroad.  
When you receive a reply it will include all the information on any shortfall you may have going back to 2006/07 if appropriate and how and when you can make any payment.  
We do advise customers to contact DWP before making any payment to ensure that any payment you make will benefit your future pension.
