I am a NON-UK resident (Australia) but my pension has a tax code 1257 L M1 Why am I being taxed as I'm not a uk-resident and how do I go about claiming a refund. I can't get a gateway account as I'm not uk-resident and I've spent hours on the phone but nobody has ever answered (yet)

Thanks. Any idea of an address to post it too. Might be being stupid but I can't find one. Also how do I apply for exemption from UK tax under a double taxation treaty? Thanks again

One last question - hopefully. How are refunds done? Nowhere on the form does it ask for bank details and HMRC certainly doesn't have them? If a cheque is sent that would be of no use as no banks here accept cheques in foreign currencies and I don't have a uk bank account!?

If the tax is being deducted by the pension provider, this would be refunded when the revised tax code is used.

Thanks but it wasn't a tax code thing - I don't think, it was because my pension provider messed up and was 3 months late in paying so the monthly payment went above the threshold (even though it was really 3 months payment). How is the tax code changed? Do I have to apply somewhere for that? Thanks

Hi Colin Haywood-Gray,
If we approve the code NT for the income, you will receive a full refund as soon as it is applied.

Thanks but my question still is how do I get the refund? HMRC don't have my Australian bank details and as mentioned before a cheque is worthless as I have no way of depositing it

Hi Colin Haywood-Gray

We cannot make a refund to a foreign bank account. You would need to nominate someone in the UK to receive it and make the transfer to you.

 Hi,
If we are issuing a new code, you will get the refund from the pension provider when the code is applied.

Thank you but I've already been told that. My question was do I have to resubmit the R43 or does HMRC bounce it back to me? How long does it take to change the tax code? Will I ever receive any correspondence from HMRC or do I just sit indefinitely and wait? Thanks

You won't need to complete another R43 form. If a new tax code is not in place please contact our Income Tax department to review this Income Tax: general enquiries

Thanks but that link doesn't really help as you need a gateway account to be able to submit an enquiry and as I live in Australia I can't create one. Any other way of submitting an enquiry about the tax code, and please don't say phone as I've so far spent 3hrs 35 min waiting for somebody to answer and nobody ever has

Thanks but that link doesn't include anything on the PAYE webchat and according to the HMRC community forum the webchat was taken down at least 3 years ago!!!! I've sent in an R43, written to the address provided both at several months ago but not had anything back. Nobody ever answers the phone what on earth am I supposed to do to get my refund. I feel like I'm banging my head on a deaf brick wall

Hi I am a UK resident and have a SIPP. In my Expression of Wish Form, I have nominated my nephew as a beneficiary in the event of my death. My nephew lives and works in Dubai and has done for 15 years. He is married and has a child there and owns a house there. He has no ties at all with the UK, other than being born here. I am aware of the UK tax rules for pensions if I die pre 75 and post 75. However, if I die after 75 will my nephew still be able to receive money from my pension tax free? Either because he is non-UK resident/domiciled or as a result of the UK UAE DTA? Many thanks
