I have had the same problem. I cancelled my self employment years ago as I chose not to go self employed. I never earnt a penny. I was told on the phone whilst cancelling this that they could see I had not earnt any money & said I didn’t have to do a self assessment. I opened a letter today stating that I had a £100 fine for late self assessment?

I have the same problem however I have never received a letter, email, or phone call from HMRC and only saw this when logging on to change my PAYE tax code today. The fines have built up to over £800 and HMRC has never contacted me. I attempted to fill in the online form to declare that I am not self employed, and it said they could not process the request because my address details don't match, even though the address on my account is my correct and current address. Going to be an interesting phone call tomorrow, I certainly will not be paying a penny of this so-called "penalty".

my wife is not and was not self employed, she put tick on the form: I've never been self employed, but she still has to fill in the field when she stopped being self-employed it has no sense .She spoke to HMRC and got confirmation and now again HMRC is sending penalty letters to be paid !! People, what a mess you have in there? you can't get through, and once you get through, nobody writes down what you say and you can't do it online as well ... so how?😡

Hi,

If you are completing this online we would not expect a self employment page to be completed.

Section 4, 'Fill in your return', has a self employment page, you need to go to that page and scroll down and you will then be able to delete the section.

Thank you.

Seems to be a bit of a trend forming here - I too have been receiving Self Assessment returns and statements since April 2021. I've been in a fulltime position since November 2009 on a PAYE scheme and have never been self-employed. My latest SA statement now claims that I owe £862.75 in penalties and interest. I've filled out the SA removal request form multiple times, going back to April 2021 when I received the first statement - I'm told upon completion of this form, that I'll receive a letter within 15 days confirming the removal or asking for further details and have never once received these letters. I've completed the form again this evening after not being able to get through on the phone, but I'm not expecting a reply. Could be a coincidence, but this seems to have happened after my wife contacted HMRC regarding our marriage allowance earlier in the year. Why that would have led to me being put on SA, I cannot fathom. I've also completed the complaints form this evening, quoting my reference numbers for all of the SA removal requests I've made, asking why they've never been responded to or actioned. I've also asked why this happened in the first place and what will be done to compensate me for the considerable stress this is now causing me and my family. From recent experience, I'm not expecting a response, so am also taking legal advice.

I have as received a penalty letter from hmrc chantry house, boston, lincoln lane of £100 pound for not filling my tax returns for year entend 5 april 2021 I am shocked as I have NEVER BEEN SELF EMPLOYED I'm my life I have always been on wages, so after spending almost 5 hours speaking with different operators(4) of SELF assessment help decks NONE of them could assess my account they all told me that the can't see me as a self employed in their database that they would sent an Eform to a special department that deal with that, they also sent me their address to write the a letter that I have done as well, please can someone explain why I received that letter? As even the hrmc help desk could not help me please I have never been self employed

Hi Clara maxim

If we have sent a referral we will be checking this and if you do not meet the criteria for a return we will cancel the request and the penalty. There are other criteria for completing a return, you can see more criteria here:

Hi I have received a letter for overdue returns and penalties for £2022, from the tax years of 2019 and 2020. I am no longer self employed and have not been for over 4 years, I believe i did cancel my self employment when i was no longer working. I was not aware that I had to file tax returns when I was no longer working what so ever and not earning any income to pay any tax, I hadn’t received any sort of notice that I was meant to do a self assessment over that past couple years and now I have received a fine for something I was not aware of. What is the best way to go about this ?

Hi,

If you contact our Self Assessment team, they will advise if they are able to cancel the 19/20 return.

If so, they will be able to ensure the record is closed and 20/21 cancelled if requested and no further returns are requested.

Thank you.

I filled in the form to say I've never been self employed in early Feb. Was told I'd receive an email within 2 weeks, heard nothing until today, which was a message saying I'd been billed £100 for not filling in my self assessment.... Now I need to waste more of my time resolving this issue. Can someone please let me know where is best to go and what to do for the fastest solution because there's no way I'm paying it, I'm not self employed and I've filled in the form to say this long before the deadline.

Hi,

Please note that you can be asked to complete a Self Assessment tax return for a number of different reasons, other than if you are/were self employed.

If a return is issued for a specific tax year and you fail to complete it on time, a late-filing penalty is automatically incurred.

Please therefore complete and submit your 2020/21 reurn as soon as possible.

If you have valid grounds for appealing the late-filing penalty, please submit a written appeal, which will be given due consideration:

Check if you need to send a Self Assessment tax return  and :

Self Assessment: appeal against penalties for late filing and late payment     .

THank you.
