  • RE: Tax on state-related UK pensions when resident abroad

Thanks for the advice. A couple of points for anyone reading this thread later: The link above is to an internal (password protected) HMRC document; the external link is https://www.gov.uk/hmrc-internal-manuals/international-manual/intm343040 We have been told that the Portuguese tax office will not now accept the UK DT-Individual Form. Instead, getting the Portuguese Certificado de Residencia Fiscal now needs proof of UK income before it will be issued (ie. they basically want the same information the UK government does, but before it is sent to the UK government, and in their own format ).
  • Tax on state-related UK pensions when resident abroad

I spent my working life in the UK but am moving to Portugal, where I am now resident. I am trying to sort out tax on my various pensions, within the rules of the 1968 Double Taxation convention between the UK and Portugal. I have a number of small occupational pensions which are in some way government related: MyCSP (civil service), Teachers Pension, and USS (universities). According to the convention: " pensions paid out of public funds of the United Kingdom or Northern Ireland or of the funds of any local authority in the United Kingdom to any individual in respect of services rendered to the Government of the United Kingdom or Northern Ireland or a local authority in the United Kingdom in the discharge of functions of a governmental nature, shall be taxable only in the United Kingdom" Which, if any, of the 3 pensions above does thi s apply to? And how can I get proof for the Portuguese tax authorities that this rule applies to these particular pensions? Thanks
  • RE: P85 questions

Hi HMRCAdmin 25 Thank you for your reply. Everyone else we have talked to so far has told us we need to submit a P85, not to reclaim tax, but just to notify the UK govt. of our residence abroad. Can we take it that a reply from you telling us not to is an official response from HMRC, that if we have to we can quote in future? We will be submitting the form DT-Individual, but are waiting for acknowledgement from the Portuguese dept. of finance that we are now resident in Portugal, so that we can get it stamped. Thanks again
  • P85 questions

I am a pensioner permanently leaving the UK for Portugal. I have dual UK/Portuguese nationality. I submitted a self-assessment form for 2024-25 in May 2025, when I also started the Portuguese government that I am becoming fiscally resident in Portugal. I now need to notify the UK government that I will be having my UK income - pensions and a small amount of bank interest - taxed in Portugal, and that I will no longer be tax resident in the UK. As I understand it this means I first need to complete a P85, which is raising some questions: 1. Date of moving country. When do I take this as being? The day I submitted my request to the Portuguese government to become resident in Portugal? The first day of the current tax year (2025-6) since my tax affairs in the UK are up to date for 2024-5? The day I arrived in Portugal to look into sorting all this out? 2. The section on income wants a tax reference for each pension, but I don't know where to find a tax reference for the state pension. They don't send me a P60, and there is no reference to one on the tax code notice. Where do I find this? Thanks
