Hello, I'm the director of a limited company - I'm the only director and only employee of the company. Through the limited company I sell goods online through a website (60% retail customers, 40% business customers), goods are purchased by the company directly from the manufacturer. I also do some work for a small number of customers (fitting of some parts that the customer has bought from the company). I pay myself each month through PAYE from company profits. I was looking at doing some delivery jobs for a courier company alongside what the company already does and invoicing them through the company as I do with other customers but the courier company has concerns that this may fall foul of IR35 rules and would prefer to give the work to a sole trader rather than somebody who works through a limited company. The reason I'd rather work through my company is that I'm already taking a wage from the company, and the company already owns a van which has the correct insurance for the job and it wouldn't make sense to buy a second van with another insurance policy just to deliver as a sole trader. As a driver for the courier company I'd be supplying my own vehicle, insurance and working my own hours, there is no minimum hours as the drivers take shifts when they want. I've looked at various bits of information regarding IR35 online and found it confusing. Would it be possible to find out if IR35 would apply in my case?

Hi
The IR 35 process is linked to Employment status, this is not something we can advise you on.
