I spent some time on the business investment relief and would like to confirm if my understanding is correct. 1. Two Hong Kong directors setup a UK limited company(only two shareholders, and same as directors) on March-2021, and two Hong Kong directors then moved to UK on Aug2021 under the BNO Visa scheme. 2. The UK limited is doing buy to let business, generating income from rent and some property investment project including sale of property 3. Two directors are going to sell their Hong Kong non-residential property during 6-April-2024 and 5-April-2025, and it will trigger capital gain, two directors will claim remittance basis for the tax year 6-April-2024 and 5-April-2025. 4. Two directors will then loan the fund to their UK limited company, the company will utilise the fund to invest on residential property and commercial property. 5. The UK limited will not disposal these properties within 5 years I would like to confirm if there is the case, does the CGT exempted to both directors? If my understanding is correct, which part of self assessment that the directors has to report ? Thanks a lot

An individual intending making a business investment can ask HMRC for their opinion on whether a proposed investment can be treated as a qualifying investment under the Business Investment Relief provisions by applying to the Business Investment Team - details in RDRM34380.

. A claim to Business Investment Relief is made on form SA109 at box 38
