Hello, We are returning to the UK after 6.5 years in an EU country. We have a house in the UK which has been rented out. We also bought a house in the EU country and are now selling it. I do not recall ever officially declaring the UK house as main residence when we lived there nor the EU house after we moved. Will there be CGT on the EU house if it is sold shortly after we are back in the UK? Thanks!

Hi,

If no nomination was made, the EU house would be seen as your main residence based on the facts. You would then qualify for Private Residence Relief on that property and therefore it is unlikely that Capital Gains Tax would be due.
