Hello If I gift my spouse some of the cash proceeds from a share sale, can I obtain relief from CGT for the cash gift? Thanks

Thanks. The sale hasn't happened as yet but will by 31 December 2023. Does this make a difference,

Hi,

There is no tax liability from the transfer of assets between married couples and civil partners and there is no tax liability for cash gifts.

Thanks. Does your response mean that the first response - “No, as the gift is after the actual sale” - was inaccurate? Also, can you clarify is there’s a special HMRC form to declare a cash gift to spouse when completing the SA Capital Gains tax section.

Hi
It means you cannot claim the gift as a reduction in the amount of gain that you pay.
You have sold the asset and then transferred the proceeds.
You do not need to declare what you have done with the proceeds.
