Details: Newly divorced, house is sold, need to determine my share of CGT. It was joint named for the mortgage but I paid the 10% deposit by myself. Would my share of purchase then be 60% instead of 50%? To be fair I paid for everything during our marriage but it was all in joint names. However court order for the proceeds is 60%/40% in her favour. For my share of sale proceeds, do I take 40% as allocated by the courts or is it still 50/50 as per ownership? Thanks in advance.

Hi,

As the court has ordered a 60/40 split, your share will be 40%.

Thank you.
