Dear Sir/ Madam Is SDLT due in the following scenario involving UK and French property; I wish to gift my sister my 1/3rd share in a UK property (which is a second home), value of my share £100,000. She owns 1/3 of the property already (also a second home for her). I am aware of the CGT payable on my 1/3rd share in UK (50k increase in value). In exchange, my sister plans to gift me her 50% of our deceased fathers, French property, with a value of £52,000 for her share. At the time I would own the other 50% of the French property. No Money is changing hands. There is no guidance/examples on HMRC illustrating anything similar to the above, especially involving foreign property. Is SDLT due on the above scenario? If SDLT is due, would it be 3% (3% 2nd home SDLT over 40K under £250k) of the difference in the values £48,000? Kindest regards W
