Hi. My wife and I bought a second home an the title deeds are in her sole name only. We bought the house using funds from a joint account and in fact I actually signed the cheque payable to our Solicitors for the full purchase price. There in no mortgage. Is it in order for us to submit separate returns to HMRC in respect of the CGT due? Thanks

Hi Ronnie206 Hooper,

If the house is in her name only, then the gain will solely be in your wifes name.

Unless you have previously notified HMRC of an alternative split of the beneficial interest on any income that may arise.

CG22020 - Transfer of assets: spouses or civil partners: jointly held assets

Thank you.
