Hi, We are looking to purchase a property through gatehouse bank via a buy to let islamic mortgage. The finance structure of this mortgage is the bank holds the freehold and the buyers are leaseholders. Once the mortgage has been paid fully than the bank transfers the freehold title to the buyers. Can you advice would you need to pay capital gains tax at that point. Also are you aware of any other instances that CGT can be due in relation to gatehouse bank.

Hi Turmeric,
The provider of the mortgage is not relevant.
For current rules you would not have Capital Gains Tax to pay as the freehold is being transferred to you and you are not disposing of anything.
We cannot say this will be the same in the future as legislation may change.
