I currently rent out a property which is 100% owned by me. I'm going to do an equity transfer to my children (two of) so we will hold shares of unequal amounts in the property. Can I still have the full rental income and continue to complete the self assessment as previously or do we have to share it by the percentage of the equity held? If I can have 100% of the rental income how do I/we declare it or is it dealt with by me entering the self assessment ? Also, I have equal shares in a property with my partner (living together for over 25 years), we are going to rent it out and I'd like her to have 100% of the income. This will properly be answered by the above but if not can you please give me the answer.

Hi,
As transfer part of the property, this will be seen as a disposal and as such Capital Gains will be due - .
With regards to the rental income received, you can still be classed as the beneficial owner of all the rental but you need to submit a declaration of trust to show the split.
This also applies to the property owned with your partner.

Thanks for the info. Would I submit the declaration to the address as detailed within the form 17? Also, would a declaration styled on form 17 be acceptable for declaring the beneficial split?

Hi,
Thank you for your question.
As you have declared that you are neither married or in a civil partnership, all that is required  is that you declare the actual percentage of profit you received individually.

Thanks for your response, that's makes it clear what I need to do. Sorry for being a pain, but where do I declare it / send it to?

Thank you for your question.

You both need to complete the Income from Property supplementary page to declare your property income
and claim your expenses.
