Hi, would like a bit of guidance. Background here: 1. me(husband) and wife are foreigners 2. co-owned a rental property in UK 3. received rental income in husband account via agent 4. Only wife receive letter from HMRC to file tax return Questions are: 1. does husband need to file tax return 2. if both need to file tax return, should income and expenses only appear in husband return or divide them evenly in both returns.

Thank you for your question.

Profits and losses from property jointly owned by husband and wife is treated as arising on an equal basis (50/50) unless HMRC is notified otherwise.

Please see guidance  :

Work out your rental income when you let property

Therefore you both husband and wife will need to complete a tax return.

Income and expenses will also need to be divided in equal shares; those figures are then entered on to the tax return.
