I am salaried, paid monthly. I salary sacrifice a small % of my gross pay for 6 months a year, and then a very large % of my gross pay for the other 6 months a year. Over the tax year I average above national minimum wage. Is that sufficient of does every monthly pay slip need to meet/exceed national minimum wage please?

Hi,
HMRC can only provide general advice and signpost to guidance.
Where a genuine salary sacrifice is in place, a worker no longer has entitlement to that amount of pay under their contract.
This means the amount of the salary sacrifice is not included in a worker’s total remuneration for National Minimum Wage pay purposes.
