What is the latest an employee can start their maternity leave? An employee wants to work up to the date of birth. What happens is the date of birth is after their due date? Would Mat leave then start on the day after the birth? - what documentation would we need here? Thanks

The latest maternity leave can start is the day after the child in born. You do not need any proof of when the child inborn. Ypu can see guidance here:

The guide is very vague, Please can you confirm an employee can work past their EWC date if their baby has not been born, right up to birth If allowed, I am assuming for the basis of the AWE calculation the EWC should still be used. Please can you also confirm Many Thanks

The employee can work past this date and the AWEs would not be recalculated.
