Hello, I'm an EU citizen and I left the UK at the end of 2020 after over 4 years of residence (and employment) in the UK. I haven't submitted a P85 form because of various access issues to my personal tax account (now resolved). I would like to create a limited company for which I would be the sole director/employee. Do I need to submit a P85 form before creating a limited company? Does having a NI number mean I need to pay National Insurance Contribution and/or receive a salary through PAYE? Thanks, Guillaume

Hi,

If you create a limited company, then the profits will be subject to Corporation Tax and not Income Tax. As an employee of the company, you would complete and submit P85, to notify HMRC that you left the UK and to seek the issue of code NT for your employment.

Get your Income Tax right if you're leaving the UK

Thank you.
