A settler created a trust, containing a life assurance policy, whole of life, unit linked. Settler died in 2004, policy was discovered in 2013, when the policy paid out, the tax paid for the payout was in the name of the settlers surname was her previous marriage name. Is this right, the settler did change their surname when they married, as there is a document on hmrc proving this

But why would you pay tax using a women surname before marriage, when the lady passed away, policy was claimed 8 years later, why not pay tax in her surname, created by marriage...let's say the trustees declared that she wanted it terminated and believed it was terminated. If terminated before marriage, would it then be taxed in the surname before her marriage
