Dear HMRC, I am resident in the UK and is currently in a divorce process. The divorce proceedings are based in Switzerland where my future ex is living. Q1: Is the monthly spousal maintenance taxable income? Q2: If the monthly spousal maintenance is paid in one lump sum as part of the divorce settlement instead of being paid in monthly instalments in the following years, will the lump sum be treated as taxable income? Q3: Is the transfer of my share of matrimonial assets to the UK taxable income? There is only cash in a bank account. No shares or real estate are involved. I understand that interest on the cash would be taxable as usual. Q4: Does the answer to Q2 and Q3 change depending on whether the payments are made before or after the date of the final divorce settlement. Thank you

Hi,
The spousal support is not taxable income.
For the transfer of the home, you can see guidance here:
HS281 Capital Gains Tax civil partners and spouses (2024)
Thank you.
