Disability VAT relief

There is a path (700mm) around my house I’m having this replaced and widened to between 2500-3500mm I’ve submitted a customer declaration for VAT disability relief requesting relief on 1500mm (widening the path up to government guidelines). The builder has refused to assess the work against HMRC guidelines, citing ‘I’ve been stung by this before’ and telling me ‘We don’t offer that’ I thought they had a duty of care to review all requests and evaluate as SME’s to provide an assessment and decision based on work being under taken vs HMRC guidance As they have refused to assess my request I’m not sure where to go with this, Any Help?
