RE: Is notification required for a deed of variation?
I am not sure if this the correct way to post a question? I am making a deed of variation to redirect a deceased’s AIM shares from a named beneficiary to a new beneficiary. The IHT is unchanged as AIM shares are outside of IHT, and there was no initial IHT to pay for the estate as everything was left to the deceased's spouse. We therefore did not need to fill in IHT400. However, I am now being told that because the ISA is a stocks and shares ISA containing AIM shares then Business Property tax relief applies, and you can only claim that specific tax relief if an IHT400 form is completed (along with IHT412). Please could you advise me on this. Many thanks.
