I appreciate the asset in question is exempt from CGT. From a wider perspective is the loss due to fraud and theft not a loss one can record as a loss somehow/somewhere as one has lost over £80,000 in this case due to fraud and theft even if it is not attributed to a specific asset it is a loss nevertheless which cannot be reclaimed. -
Can you claim for capital losses following fraud by an unscrupulous contractor.
Where an individual has contracted for services i.e. Building Work to be completed on their property and subsequently the Builder or other third party takes the money and does not provide the services contracted for. Can the loss to the individual be claimed against other gains? Please note legal avenues have been consulted and there are no legal routes to recover the assets as the company contracted to has been liquidated and no recourse is available against the director who stole the money.
