My daughter has to pay back some of her occupational maternity pay. Her employer wants her to pay this back gross as it relates to a previous tax year. We believe she should pay it back net and the employer claims the tax and national insurance back by submitting a prior year submission on their payroll. Which situation is correct ?

My daughter is being asked to repay some of her occupational maternity pay as she did not return to her job at the end of her maternity leave. Her employer is asking her to repay this gross as it is in a previous tax year. We believe she should make the repayment on a net basis and her employer reclaims the tax and national insurance by doing an earlier year submission on their payroll. Who is correct ?
