  • RE: Second time redundancy same employer

    I have been sent guidance that suggests thats not accurate from my employer as below and they are saying its not the case. Only one £30k exemption is available from one employer. If this has been utilised in the past it cannot be used again. Group Tax challenged this with HMRC a number a years ago, and following discussion with their Technical team, were told only one £30k exemption is available, even if there is a gap in employment. Group Tax have also confirmed that the tax legislation as worded in s404 ITEPA covers different employments with the same employer (section 1(b)) and also includes no time span for which previous payments may expire (section 4):

    im being made redundant from same employer 15 years apart. i have been told that i do not get full £30k tax free cash due to previously being made redundant. Neither HMRC or my employer appear to have records to show what o had previously so i do not know how much of £30k i have left. Should i just give a rough figure? no idea what else to do
