  • RE: CGT for a Probate Property

    Your own tax status is not relevant as the Estate is the tax entity. An estate has the same CGT allowance as an individual (£3K) but only for the tax year in death and 2 subsequent years. An estate pays CGT at the top rate. You also need to declare it within 60 days of sale. The short answer is, yes...there will be a CGT liability.
