RE: 90 day tie
Hello, I am still struggling with the wording of this provision, where it says "either or both of the previous 2 tax years". It seems HMRC Admin 19's response at the beginning of the thread conflicts with HMRC Admin 25's response later in the thread: HMRC Admin 19: "It is 90 days in a tax year and it can be either of the 2 previous years." HMRC Admin 25: "It can be either year eg, 85 days in year 1 and 5 days in year 2. As long as you have spent at least 90 days within the last 2 tax years." These responses are not compatible. The first would indicate that if you are 90 days or less in each previous tax year, you do not meet the 90-day tie. The second indicates that a total of more than 90 days across two years establishes the tie. Which is it, and why the discrepancy in responses? If it is the latter (as per HMRC Admin 25), then why not just say "more than 90 days across the previous two tax years"? Thank you. -
RE: Accessing previous years tax returns (self assessment)
Hi, I have misplaced my Self Assessment tax returns for 2013/14, 2014/15 and 2015/16, which I submitted through commercial software. Will HMRC be able to provide me a copy of these for my records if I write to you? Would these old submissions have been retained by HMRC? Thank you.
