Non Resident in UK based on Statutory Residence Test - Automatic Overseas Test 3
Hi I moved to Spain in Dec 23 for full-time employment in Spain. During tax year 2024-25, I will be visiting UK few times on work trips and it will total to 29 days between 06 apr 24 and 05 apr 25. I have 2 questions: 1. Will my work trips to UK be counted for the purpose of Automatic Overseas Test and therefore not apply to me as I will be spending more than 16 days in UK? 2. Will I qualify as non-resident under Automatic Overseas Test 3 as I will spend fewer than 91 days in the UK in the tax year; the number of days on which I work for more than 3 hours in the UK is less than 31; and there will be no significant break from my work in Spain Thanks in advance -
RE: UK Tax Resident with Employment income from Spain
Hi Please confirm if I should enter the employment income both under employment income section (i.e. like a normal UK employment) as well as in the foreign section or only in the foreign section? Thanks -
RE: UK Tax Resident with Employment income from Spain
Hi Thank you for the response. I am definitely a resident for tax purposes as I lived in the UK for more than 183 days. So, am I right in assuming that I show the income and tax deducted in the foreign income section and then use the same info to claim FTCR in the FTCR section? -
UK Tax Resident with Employment income from Spain
Hi I worked in UK from Apr to Nov last year and moved to Spain in Dec 2023 . I have a P45 for Apr to Nov. I have employment income in Spain from Dec 2023 to Apr 2024 on which I have paid Spanish Income Tax. What sections in my Self Assessment should I fill in to declare employment income from Spain and to claim FTCR on the Spanish Income Tax I have already paid
