Hello I wish to close down my business and start a new one in a similar field. On closing down my business I know I can take out the retained earnings and pay capital gains tax. If I was to claim entrepreneurs relief I would not be allowed to set up a similar business for some time after this. If I do not claim entrepreneurs relief, then can I set up a similar business straight away? Thanks David

Hi

We can only point you to the conditions for that relief  HS275 Business Asset Disposal Relief (2023).
However we cannot comment on the position with setting up a new business.  
There is guidance here CTM36305 - Particular topics: company winding up TAAR: targeted anti-avoidance rule (TAAR). This might be what you are looking for but we cannot comment on it.
