Me and my current wife own our home outright but she wants a divorce. Her family want to buy me out of my half of my house so I can use this money to buy a second house for me to live in (with a small mortgage). Then we will start divorce proceedings. I'm not sure if they want to put my half off my current property in their name or my current wife's name. Will I have to pay capital gains tax in any way shape or form if I agree to go ahead? I would obviously prefer to simply sell our current home, divide the money and each buy our own seperate homes if this is the case.

Hi,
If it is still your main and only residence then no capital gains is due. this is based on current guidance and we cannot comment on future events as legislation may change.
Thank you.
