Hi, Advice please - I'm transferring my share of a property to the current co owner, can someone tell me if the 60 day period for declaration of CGT starts when the TR1 is sent to the Land Registry or when the Land Registry confirm the change in ownership? Thank you

Hi,
Please refer to the following Guidance - Report and pay your Capital Gains Tax - the 60 day reporting period starts from the completion date the transfer takes place.

Hi, Thank you for your response - I'm struggling to find out what HMRC consider the completion date that the transfer takes place is. I've searched everywhere on the HMRC site and can see nothing that helps. Would you be able to tell me if HMRC define "completion date" as when the TR1 is sent to the Land Registry or when the Land Registry confirm the change in ownership? Thank you

I have a similar question. I am transferring a share of an investment property to my children so should the 'completion date' be the date on which we sign the Declaration of Trust? Also, for paying the CGT on this transfer do I complete the standard Capital Gains Tax on UK property account form even though the entire property has not been sold? Many thanks for your feedback.

Not HMRC...its the date the transfer form was signed and dated.

Hi,
The completion date is the date the keys are exchanged. This applies even when gifted.

Hi Westmorland,
The completion date would be the date you officially hand over the share so yes you can use the declaration of trust date.
When completing the property disposal return it asks how much of the property is being disposed of.
