Hi I am in the process of divorcing my wife. I left the family home on 6 January 2023. My ex-wife will keep the house and will sell it when at a later date. presumably between 2027 and 2028. I will not gain anything from the sale of the property. She will keep the whole equity. However, the bank does not allow us to transfer the property to her name, as she does not make nearly enough money to cover the mortgage. We currently have 213,000 pounds outstanding in the mortgage, with a mortgage deal ending in May 2027. So my questions are: How do I avoid CGT? How do I transfer the property to her in these conditions? Kind regards

Ok, then how can I transfer the property to my ex-wife, if the bank does not agree, given her low income?

Hi Nuno Raposo,
You would need to discuss this with a solicitor or financial advisor.
Thank you.
