Can I claim preferential origin when the seller is a US entity, but the goods are sent directly from Japan? If so, what proof of origin do I need to obtain? Thank you so much for your attention and participation.

It irrelevant who sells the goods. To claim preferential origin the goods must qualify under the UK- Japan trade agreement or the CPTPP agreement. The exporter must provide a statement on preferential origin ( wording is in the agreement) under UK Japan trade agreement. Under CPTPP the exporter, producer or importer can provide a statement on origin. This must contain the specific details and wording set out in the agreement. The best place to look for requirements is in the UK trade tariff for your particular goods an use the origin tab.

@Customs oldtimer - please consider the following as it is not always the case. Importing from and re-exporting union goods to the EU - flowchartWill the goods be subject to any form operation? - NO - The goods will retain EU non-preferential origin but lose all preferential status

I responded to a question about goods being consigned from Japan with a USA based seller. The link provided is in relation to the UK -EU agreement so no relevance to the question originally asked.

Thank you for your evaluation. I'm seeking HMRC advice.

Hi Howco,
You’ll need to classify the goods you import
•    with the right commodity code,
•    check they meet the rules of origin, and
•    get proof of their origin.
Please see the guidance at:
Pay less Customs Duty on goods from a country with a UK trade agreement
Thank you.
