Hi, I understand that inheritance tax is payed by the estate (at least in the UK that is how it works) and only the remaining amounts are payed to any eligible people after this tax is deducted. In that way if someone inherits something all tax is already payed (assuming no gifts have been made beforehand). I am a German citizen living in the UK and being a UK tax resident and might inherit from my German relatives some time in the future. This might be property but also cash. How will this inheritance from abroad to me be taxed and how do I need to declare it? Especially since the property will never be "brought" to the UK. Thanks!

I don't know how to get a question put on this forum. Basically I'm expecting to receive a small amount of inheritance from Australia. I know I shouldn't be taxed on this, but how will HMRC be aware as to not to tax me?

Hi,

As a foreign inheritance is not taxable then we would not be aware of it unless you advised us.

Thank you.

Thanks for your reply. I've sent a letter to HMRC Inheritance tax to say this and asked them to acknowledge my letter and they haven't. How else can I do this? I tried to ring previously and this type of situation isn't one of the options. It's very frustrating to be honest.

Hi,

Inheritance tax is only due on UK assets. Therefore inhertance that you receive from any where that is not the UK is not taxable and does not need to

be declared. You will not be taxed on it and there is no need to contact HMRC.

Thank you.

Hi, I can see all the posts clearly stating that no inheritance tax is due on non-UK assets (other than CGT on sold or income from assets) but its not explicitly saying whether that inheritance has been remitted to the UK or not. Am I correct that even foreign inherited amounts (cash) remitted to the UK (I am Australian citizen, UK resident) no UK inheritance tax will be due. And if that is correct - no other form of tax on that amount would be due - even if remitted to the UK? Many thanks, Claudia

Hello, I can see the information from other posts saying inheritance tax is uk is only due on UK assets . I thought that after latest budget in 2024, UK was going to tax worldwide assets. Can you please clarify? I am Spanish citizen resident in UK. Many thanks

My husband inherited one-seventh of the estate of his deceased aunt who died in April 2024. She was a South African citizen who never lived in the UK and all her assets are South African. The estate comprises two properties, shares and cash savings. The shares were liquidated and the properties sold and we now have the final Liquidation and Distribution Account for all seven beneficiaries. Presumably he will need to pay CGT on any profit generated by the sale of property and shares . If so, how will this be calculated and will he be expected to pay one seventh of the capital gain? What supporting documents will be required ? Also, South Africa has a double tax agreement with the UK - will this be applied in this case? Finally, as these are all foreign assets, does he need to make any formal notification of this using any IHT forms or does he simply need to declare these on his forthcoming self assessment tax return?
