Hi, I’m resident in the Uk and I’m planning to open a limited company to use it for investments in Spain. Would I need to pay corporation tax and capital gain tax in Spain and also in the Uk as I will be resident here, but the company will be working in Spain. Please let me know. Thanks

Can a UK company work with a Freelance person who has moved from the UK to Spain and is now a Spanish Tax payer? Does a UK company have to do anything. Is this allowed. Sometimes it could be 2 days a week in a month. But not every month. Sometimes it will be just commission on a sale like once every 8 weeks.

Hi,
You would need to establish if the person doing the work for you is classed as employed or sef-employed for tax purposes under UK tax legislation.
If they are classes as self-employed they are responsible for thier own tax affairs.
If they are an employee, please call the Employer Helpline on 0300 200 3200 to discuss further.

Hi, I have gone through all the posts in this forum, thank you for all the clarifications provided by HMRC. I understand that the main step for someone going to work in Spain with a contract with a UK company is to file a P85. My employer will then receive a new tax code indicating that they shouldn't deduct UK tax from my salary. They will however continue to deduct class 1 National Insurance. My questions concern the "certificate" for National Insurance mentioned in some gov.uk pages (https://www.gov.uk/national-insurance-if-you-go-abroad , https://www.gov.uk/guidance/national-insurance-for-workers-from-the-uk-working-in-the-eea-or-switzerland ): 1) Is this certificate compulsory, on top of the P85 form ? 2) If this certificate is not compulsory, is there anything else my employer needs to do on the social security front, beyond continuing to deduct class 1 National Insurance ? (e.g do they need to create an entity in spain to pay social security contributions there)
