Hi team, I'd like to know if a skilled worker visa holder can file a self-assessment tax return on a second part-time. The job is under 20 hours a week and in the same occupation code as the primary sponsored job. Thanks

Dear Team, Thank you for your response. I have reviewed the link you shared regarding "Who must send a tax return." It appears that holders of a Skilled Worker visa are not explicitly mentioned as those required to file a self-assessment return. According to the new Home Office Skilled Worker rule on taking additional jobs, the link does not specifically address how a Skilled Worker visa holder should report earnings from a part-time job. Please find the relevant rule below: Taking on additional work If you work overtime in the job you’re being sponsored for, you do not need to update your visa. There’s no limit to how many hours of overtime you can do. You can also work up to 20 hours a week in another job or for your own business, as long as you’re still doing the job you’re being sponsored for. Your work must be in an eligible occupation code. You can also do unpaid voluntary work. Could you kindly clarify the process for paying tax on the additional job referenced in the rule "You can also work up to 20 hours a week in another job"? Thank you for your assistance. Best regards, Dunamis

Hi dunamis,
If the new role is under self employment you will need to declare this in a tax return to pay the tax. if under PAYE, it will be taxed at source once your employer sends the detaIls to HMRC.
Thank you.

Hello, Thank you for getting back to me. If the new position falls under self-employment, would the tax returns be filed through the self-assessment tax return? Please confirm. According to the new rule, if the new job is a business, would the tax return also be filed through the Self Assessment Tax return? Kindly confirm. Thank you. Best regards, Dunamis

Hi,
If you do not pay tax on the income you receive at your new employment, this would fall under Self Employment, and you would have to declare the income earned, and pay tax on that income, by filing a Self Assessment tax return.
If your new employment is with a PAYE employer, and that employer deducts tax from your income before you receive that income, you would not need a Self Assessment return.
Please note, if you have to complete a tax return for Self Employment purposes, any taxed PAYE income for that year must be declared on that tax return.x
Thank you.
