Re: My wife’s appeal to HMRC concerning her claim of HRP. This was initially denied and we appealed against the decision twice. The chairman of the appeal court advised that both HMRC and DWP agreed our evidence and her appeal was allowed in February 2024. This meant she could make a claim for HRP. We sent proof of the appeal decision to the DWP on 19 February by “Signed for mail”. When is she likely to hear about the adjustment to her State Pension.

Hi Richard,
If this has been sent to DWP, you will need to contact them.
However HRP is awarded by HMRC.
From your message, it is not clear if your wife has also contacted HMRC?
Can we suggest you contact the NI helpline on 0300 200 3500. Lines are open 8am – 6pm Monday to Friday.

Thank you for your reply. The letter advising our appeal had been successful said that we should contact the DWP. We realised it was to the HMRC that we submitted the original claim, but this is what the letter said. The actual words were “If Mrs Jones has already retired please contact DWP to advise of the change of her status and additional years” As we had sent the claim in to HMRC and it was now accepted, we presumed that her claim record would be updated and her claim validated. Are you now saying we have to contact both DWP and HMRC to ensure they both have her claim in hand? Your comments would be most helpful.

Hi,
HMRC are responsible for updating the NI record.  
DWP are responsible for calculating any change to entitlement as a result of an update to the NI record.
Any updates to a NI record where the customer is within 6 months of State Pension Age, or over State Pension Age result in an automatic notification to the DWP to  
consider a review of the pension entitlement.  
HMRC are unable to comment on how long it may take DWP to act on such a notification.  
Any customer who has been advised of a change to their record may wish to consider contacting DWP to establish when their entitlement will be reviewed and the outcome of the review.  
This is not mandatory, all changes and notifications should happen automatically.

My grateful thanks to all at HMRC who have replied to my posts. We have now successfully contacted DWP who have advised that my wife’s claim is in progress of being recalculated based on the correspondence received from the Tribunal, from HMRC’s response of our successful claim for HRP, from our letter and from the recent phone call we made on 8 October. My posts will now cease.
