My daughter is being asked to repay some of her occupational maternity pay as she did not return to her job at the end of her maternity leave. Her employer is asking her to repay this gross as it is in a previous tax year. We believe she should make the repayment on a net basis and her employer reclaims the tax and national insurance by doing an earlier year submission on their payroll. Who is correct ?

Hi,
While this can vary, in most cases your daughter would repay her former employer what she received from them (i.e. the net).
Her employer would then contact us to recoup any tax paid.
If possible, ask her employer to contact the Employer's Helpline for more advice.
