Hi! I have some EIS investments from 2019 for which I need to claim tax relief. I know it is possible to claim relief up to 5 years after the year of investment, but I think the actual relief would only be applied to the tax year the investment was made (or the year before that). If I wanted to claim tax relief for these investments, is it possible to do this via the 22-23 online self assessment submission somehow? Or would I have to fill out my online self assessment as normal, and then separately have to fill out paper copies of the EIS form and send them in to HMRC? Thanks!

I'm pretty sure you're stuck using the paper form - https://www.gov.uk/government/publications/enterprise-investment-scheme-income-tax-relief-hs341-self-assessment-helpsheet/hs341-enterprise-investment-scheme-income-tax-relief-2023 says "If you receive the form after you’ve sent your tax return, complete the claim form inside the EIS3 or EIS5 and send it to us." Which unfortunately sucks, as paper forms are so much less convenient :-( I'm currently waiting and hoping my last EIS3 for 2022-23 gets issued before the SA deadline, to avoid this myself.

I just found https://www.gov.uk/hmrc-internal-manuals/venture-capital-schemes-manual/vcm14140 which confirms it's OK to submit an amended return to include additional EIS claims ... but the deadline for amending returns dealing with 2019 is long past so that still leaves you stuck with the paper claim form.

Hi

You would only be able to include an EIS claim in your 22/23 tax return for that tax year.  
If your claim is for tax relief on an investment of over £33333, then this claim will need to be submitted on a self assessment tax return (SA100) and be declared on SA101 (additional information).  
If you completed a tax return for the year you wish to claim the relief for, you can amend the tax return or if that can no longer be done, you would need to submit an overpayment relief claim in writing.

Hi HMRC Admin, Is it true that one can claim EIS relief for up to previous 5 years? If yes, what's the way to claim? I too have some EIS investments from 2019 and 2020 that I've forgotten to claim income tax relief on. I was a PAYE till 2022 and started self assessment from then on. Thank you.

You should complete the claim forms enclosed with the EIS3 or EIS5 certificates and send them to us for the years that you did not complete Tax Returns and for the years that you have already completed returns, and failed to make a claim in those returns.

Hi HMRC ADMIN I made an EIS investment for tax year 23/24, but I want to claim the tax relief in the 22/23 tax year (as a high tax year for me to get full relief). Can I simply edit my 22/23 online return and add it? Or do I have to send in a manual paper form that came with EIS investment. Same approach to Capital gain relief? Thanks

You need to send in the actual EIS3 certificate to claim the relief. If looking to claim deferal relief you must also complete that section of the form. This should be sent to

Hi HMRC Admin, I have done multiple investments throughout 2019-2021. I thought I was PAYE in 22/23 and sent all my certificates in May 2023 (including the ones for the previous years). I received my tax refund through the PAYE code. Later I was notified I had to submit a return for 22/23. My understanding is that I should not claim all of the historic EIS investments in the return for 22/23, but then I will need to give back the tax refund I got from the PAYE adjustment. Should I resend all the certificates again? And how will I receive my tax refund?

Hi,

On page TR6 of SA100, box 1 is for declaring tax refunds you have received from HMRC during the tax year.  
If you declare your EIS on the tax return and include a figure in this box for the refund you have already had, it will be taken into account when calculating your tax liability.  
The online tax return also has the same box.

Hello, I submitted a paper EIS5 in February 24. The Submitted Claim page shows it as being received and a couple of months later the status changed to COMPLETED. I know EIS payments are often delayed for security checks that usually take 3 or 4 months. I have received no correspondence and nothing is showing as a pending payment. How can I get an update as it is now 6 months since I submitted the form. Thank you.

Hello I claimed EIS (30%) relief 22/23 but now I need to claim EIS LOSS relief as the company is no longer trading. I am PAYE and do not file a tax return Is there a step by step guidance page outlining what I need to send in and the address as to where I send it? Thank you.

Hello, I'm trying to fill in an EIS claim form for financial year 21/22. I've previously submitted a tax return for that year, including some (different) EIS claims, but now have an additional EIS3 certificate that arrived late. On page 3, do I tick "I wish relief to be allowed in my PAYE coding", or do I tick "I have already claimed Income Tax relief for the relevant year(s)"? I have already claimed relief, but not for this particular investment (which is a new claim), so I'm not sure which to tick. Any advice would be appreciated please? Thanks.
