My ex employer refused to give me my p45 form. I tried to take the help of HMRc but they said they can't help in that what should i do

Hello Team, I resigned from my old job in May 2023 and started a new job in June 2023. My old employer sent the P45 form and submitted Part 2 and 3 of the form to my new employer. However, my PAYE account still shows both my companies as my employers and my tax code is incorrect for the year starting Apr 2024. I also updated the end date of my first job as submitted a tax code change request, but I did not hear from HMRC. Please can you help me with the reason for this, given that my P45 was submittted? While it could be that, even though it appears to have been submitted, we may not have received your P45, there are other possibilites.

Despite requesting and receiving a P45 from my first employer and confirming they've submitted it to HMRC with the correct leaving date, my HMRC account still shows me as employed with both companies, and I'm still being taxed excessively in my current job. I'm unsure whether to send my first employment's P45 to HMRC by post or wait for the system to update. Also, I'm concerned about whether I'll receive a refund for the overpaid tax. What steps should I take to resolve this issue effectively and ensure the correct tax assessment moving forward?

Can a P45 be amended and reissued due to an incorrect home address. Our employee who left last month has just advised her address is wrong. As we send out P45s digitally it will be difficult to get her to 'hand back' her original P45 before we issue her an updated one, so do we have to refuse her this amendment?

The P45 is no longer submitted to HMRC, it is an employee document that may be used for a new employer (subject to certain rules). The old employer has to tell HMRC that you left via their FPS and should have done this at the same time as processing your final pay. You should email / call the payroll department at both pervious employer's and ask them to tell you the date of the FPS submission where they made you a leaver and notified HMRC, and then with this (you will also need their PAYE reference which is usually on the payslip, and definitely on your P45 copy) you can call the HMRC employee helpline and get them to check the submissions and update your record. You will receive a new tax code should you be owed any money from HRMC

Hi Lisa Beale,
No, once a P45 has been issued it cannot be amended and reissued.
A letter should be given to the employee confirming an error has been made on the P45 and providing the correct details.
The employee should also contact HMRC to ensure their address is correct on their tax record.
They can do this in their Personal Tax Account (PTA) or by calling Personal taxes helpline if they have not set up their PTA.

Today, I contacted HMRC for assistance, but was informed that they are unable to help in this matter. The HMRC agent advised me to contact ACAS at 0300 123 1100. However, when I called ACAS, an automated response indicated that they could not assist with issues related to P45 or P60 documents. Given that my former employer's refusal to provide a P45 appears to be in violation of legal requirements, I am unsure of the next steps to take. If your previous employer has updated your pay and tax electronically, as they're obliged to, we may now have received your final pay and tax figures from them.
We can then update and issue your code for your new employer
If you require your physical P45 for some other reason, and your employer continues to refuse to provide you with it, write to us to confirm this at Pay As You Earn and Self Assessment,

Hi I was made redundant in June of this year 2024 I then signed up with employment agency which I emailed them my p45 and now I’ve left the employment agency August 2024 but I’ve only 20 days work with them and now I’m about to start a new full time job. So can I use the same p45 from the company I was made redundant from

Hi Ross,
As you emailed the P45 to the employment agency they will hopefully use the previous pay and tax information on your final pay day with them. This means that you should not hand in the P45 from the company you were made redundant from to your new employer.
The employment agency should provide a P45 to you once they have made the final payment however if this does not happen quickly enough please complete a starter declaration form (P46) for your new employer.
