Hi, I am currently living in Canada and have been working here full-time since January 2020. I have recently come to learn that when I left I should maybe have submitted a P85, letting HMRC know about my move. I haven't had any income from the UK since I left, I only earn income and pay taxes here in Canada. Now that I've discovered this P85 form, should I submit one that is dated for when I moved to Canada? Thanks

Hi,

As the 2019 to 2020 year will have already been reviewed and any potential repayment settled, a P85 is not needed. You can however, let us know your new address (if not already noted) to keep your record updated.

Hi, I have a question regarding the p85. I left the UK in 2017. I worked there and paid some taxes because I had two jobs, but for a short time and with low wages. I did not earn the annual minimum for the tax declaration. Finally, I got a full-time job abroad. Shall I fill out the p85?

Hi Chandler,
If you have left the UK then yes the P85 would be the correct form to submit.
As it is going back to 2017 then that tax year should have already been reviewed and any refund issued.

Dear Team, I would like to ask about Form P85 for past years. I lived and worked in UK for a short time: from November 2015 to January 2016. I worked in a call center and received slightly more than the minimum wage. In January 2016 I left UK and my job for family reasons. I am currently living in Germany and have been working here full-time since November 2016. I have recently come to learn that when I left I should maybe have submitted a P85. I haven't had any income from the UK since I left, I only earn income and pay taxes here in Germany. I have no property in UK and I am not UK citizen, I am EU citizen. Do I need to sent now in January 2024 this P85? Are there any penalties for people who did not send this form on time? Or is it possible to get some kind of tax refund after submitting this form for two months of work in UK? Thank you in anticipation for your answer! Best regards

No you do not need to send in the P85 now. the 2015/16 year is now out of date for any action to be taken.

Tax if you leave the UK to live abroad
You should complete form P85 when leaving the UK or a complete a Self Assessment if you complete Tax returns.

Hello, I have a question regarding to the P85 for the 2023/24 year. I stopped working and left the UK at the end of the 2023 year and then I filled the p85 form to claim a tax refund. Recently, I received that tax refund. The question is if I change my mind, would it be possible to go back to the UK to work. My graduate route visa is ending on June 16th, 2024. That means I can still go back to the UK with this visa. So, can I pay the tax refund back to the government and ask for a work permit from my old work place after that? Thank you Kind regards, Chak

Dear team, My friend decided to travel abroad temporarily to a sunnier place last summer, but ultimately decided in November to stay permanently. He left the UK last year, having filled in online a P85 early this year. Now, after some time, he is considering renting his UK property to at least cover the costs of the mortgage. Questions: 1) From his and my understanding, a P85 should only be submitted when one doesn't expect to have any UK income in the future. That was the case then, but now he is thinking of renting his UK property. Is this a problem and if so, what steps should he take? 2) Does the personal allowance apply in this case? 3) Anything else worth considering?

Hi, I'm a UK citizen who left the UK in Oct 2023 and was paying taxes through PAYE. I resigned from my job in UK and moved abroad to look for another job without completing a p85. I'm a UK homeowner and did not know if I would be able to find a job abroad so left my property empty until January 2024. I found a job abroad and started renting my property in February. Do I need to do a self assessment to pay taxes on income from property from Feb to April 2024? Do I also need to pay taxes on income earned abroad between Feb and April 2024? Do I have to continue paying taxes on income abroad until 12 months have elapsed to classify as non resident and then stop paying taxes in UK? I already pay taxes abroad in the country I'm living in. I'm aware that I have to continue paying taxes on income earned in UK through property but is it too late to do a self assessment for last tax year and can it be done with next year's self assessment. Any advice would be greatly appreciated. Zaghaou

Hi Chak,

If you do return the the UK then your record would be reviewed at the tax year end. If you then have an underpayment of tax, a calculation would be issued with the details and how it would be collected.

Hi Neadtwailn Ncaazr,
If he did not declare that he was renting out his home while overseas on his P85, he will need to register for Self Assessment, as he will be a non resident landlord.
This can be done here:

As he is a UK national, he is entitled to claim for personal allowance, no matter where in the world he lives (this is done on SA109).
As  a non resident, he cannot complete the online HMRC taxc return.
He will need to either submit a paper SA100, SA105 and SA109, which can be obtained from the Self Assessment orderline here:

By 31 October each year or submit an online commercial tax return, which can be purchased for a fee here:

A government gateway user ID and password is required for this option.

Hi Zaghaou,
Yes, you will need to submit a self assessment tax return for the year year up to 5 April 2024 and this should include your resdidential property income.  
You do not need to include your foreign income arising from the date you started your employment in January 2024 to 5 April 2024.  
If you have not completed a self assessment tax return before, you will need to register for self assessment at Check how to register for Self Assessment.  
HMRC's online tax return cannot be used by non UK residents.  Provided they have a government gateway user ID and password, they will can buy a commercial tax return from the list provided at Self Assessment commercial software suppliers.  The only other alternative is a paper tax return which can be obtained at Self Assessment tax return forms.  
Paper returns have a filing deadline of 31 October each year.

Good morning I'm EU citizen with settled status.I've left UK in march 2022 and I've lived and worked in UK since 2017. I rented an apartment and I worked with a permanent 30 hours contract. I moved in my own country where at the moment I'm full time mommy without job. I would like to sent the application for P85 where I can see from my P45 that I can get back more than 1000 pounds taxes. But a lot of people told me that if I will do this, I can't back in UK anymore and I can't work for few years. I only would like to know ,if I will send this P85 for get my taxes back, am I still able to live and work in UK if I will decide to coming back in the next years? Also, will I lost my settled status? Thank you

Hi,

You can come back to the UK even if a refund has been issued.

You will need to contact the Home Office with regards to the settled status query.

Hi, I moved from the UK to Spain last year in May 2023 and submitted a P85 form but didn't receive a tax refund. I continued to be paid from the UK branch of my company until my Spanish residency was approved and began getting paid from the Spanish branch of my company in June 2023 once this was approved. Upon submitting my taxes in Spain for Jan-Dec 2023 I was required to pay tax on all income received since I entered Spain in May 2023. I am aware that the UK and Spain have a tax treaty to prevent double taxation. My questions are: 1. Why didn't I receive a tax refund after submitting the P85 last year? 2. How should I go about getting a refund for the months where I have paid tax in both countries (May and June 2023) 3. Do I need to submit another P85 now that the 2023/2024 UK tax year has ended? Hi, I have been a Foreign student Who has been Living and working in UK from september 2017 till june 2020. Most of this Time I Was working Part Time and all my taxes were taken through PAYE. When I finished university in june 2020 I left my job and then came back to my original Country, Poland. All this Time Never had to talk to HRMC or send any other forms. I have my NINO number for which I applied through jobcentre. Recently I learned for the First Time of P85 form that supposedly was needed to be sent at the Time of leaving UK (didnt notify HMRC of my leave). As of now I dont ever plan to Return. What should I do as of now? Send the p85 4 years after the fact? Or maybe notify HMRC of my current address and contact? I guess some letters May have arrived at the old address in UK where I Was renting at the Time, but mever reached me. Tried to Access the HMRC app but it keeps giving Me message "unable to verify identity, information does Not match the records". Since june 2020 I had no Ties to UK, no income in UK. I Am not worried about claiming any overpaid tax, rather if anything during this Time came up that needed to be addressed and possibility of penalties. What should I do in my situation?

As you were a PAYE taxpayer, it is unlikely you will have accrued any fines or penalties since leaving. Please complete and send us the P85, you can do this here:
