I recently claimed an overpayment of tax on a pension pot drawdown which emptied the individual pot (I have another small pension pot and a also Defined Benefit pension I haven't touched yet). I ran through the questions at https://www.gov.uk/claim-tax-refund and the HMRC guidance indicated that I should fill in form P50Z since the money was from a Defined Contribution scheme, I am not planning on returning to work and have no other income. I filled in a P50Z and have just had email notice of the tax rebate cheque that is being sent out to me but ... it just struck me that the question on the claim-tax-refund guidance page asks: "5. Did the payment use up your pension pot?", to which I responded "Yes". Maybe I'm reading this wrong but does the question really mean "Did the payment use of ALL your pension pots?", in which case I should have answered "No" since I have another small private pension pot (plus the Defined Benefit)? The guidance would then have been to fill in form P55. Does it matter?

It should not make any difference as the repayment would have been calculated on the income for the tax year.

I am Resident in Spain over 20 years and I am thinking of taking a private pension Would they automatically apply emergency tax to the amount before giving it to me?

Hi Sharon2,
Yes.  
You would need to claim it back, if the pension was a non UK government pension.  
You will need to download and print off the DT individual UK /  Spain form at Double Taxation: UK - Spain (Form Spain-Individual).  
Please complete the form, declaring your pensions / annuities, sign and date it.  
Then send the form to your local Spanish Tax Office.  
They will return the validated form to you, which you send to HMRC (address is on the front page of the form) along with your 'Residencia Fiscal En Espana Convenio'.
We can then arrange for the pension payer to refund any tax deducted.

On the form Double Taxation UK-Spain there is no where to put my Spanish Bank Account. I have nobody to "norminate" to receive the payment in England. How would I receive the refund? Sharon

We cannot pay into a foreign bank account and it would be  a cheque that would be issued.

Hi When completing the form (Double taxation UK-Spain) Question 8 asks if I receive "special benefits" I am disabled and receive an additional allowance on top of my personal allowance .. (would this be "classed as special benefits)

Morning. I completed my form for pension tax to be reviewed as emergency tax was applied. I submitted on the 20/05/2024. I have checked and it states your processing forms submitted on the 24/05/2024. However mine is not yet completed? How can this be. I have checked messages and nothing in there and I have not been contacted? Can you advise? Thanks

Hi I've drawn down one of my pension pots and have been charged emergency tax so I obviously need to claim back the overpayment. As I'm self employed do I have to wait until I do my annual tax return or is there a firm I need to complete.
