RE: Submit FPS for earlier tax year
Hi,
You can still send an earlier year update from the basic tools for tax years 2019/20 and before. You would submit this via the basic PAYE tools by selecting the tax year that needs amending. The employee/s concerned, submit the details on the erarlier year update for each affected employee. This should in turn update your final M12 figures for that year.

RE: AirBnB rental income
Hi,
As you have mentioned your rental income exceeded the £7,500 rent-a-room relief amount, you may choose how you want to work out your tax as shown in the following guidance depending on which is more beneficial to yourself:
HS223 Rent a Room Scheme (2023)
Method A outlines you pay tax on your actual profit for example, total receipts less any expenses incurred, or Method B where you only pay tax on the amount over the allowance, however you would then not be able to deduct any expenses or capital allowances incurred.
HMRC will automatically use Method A to work out any tax liability.

Hi,
Property losses are automatically carried forward and set against the next profit from letting the same property, so unfortunatey you will need to use part of the loss available to carry forward against your 2021/22 profit and only any remaining balance is available to carry forward to 2022/23.

Hi,
If you are in receipt of foreign income, including income from property, then this would form part of your worldwide income and should be declared on a UK Self Assessment tax return.
If you also pay tax on the income in the foreign country then you may be entitled to claim Foreign Tax Credit Reliief. Please refer to the following link for further guidance:

RE: Rental income
Hi,
Unfortunately we do not know what previous advice you have been given over the telephone.
If you receive income from a rental property then this should be declared on an 'individual tax year' basis. This means that you cannot carry forward any rental income from one tax year and just declare both amounts the following tax year.

Hi,
Where tenants in common hold property each has absolute ownership of a fractional share of the whole. Ownership of property comprises legal ownership and beneficial ownership TSEM9130. You can see guidance here:

The same person may be both the legal owner and the beneficial owner of the property but there can be a separation of the two. The legal owner is the person/s in whose name/s the property is held or registered. The beneficial owner is the person for whose benefit the property is held. It is distinguished from the person in whose name the property is held (the legal owner).
The starting point is that the legal owner is presumed to be the beneficial owner unless there is evidence to the contrary. The legal and beneficial ownership of property may be separated by a valid declaration of trust. You can see further information here:

We would need to see the declaration of trust to confirm if it is worded correctly for the purpose of transferring your 50% share of income to your wife.

Yes, you can transfer the profits to your partner via a declaration of trust, you do not need to complete a form 17.
