Hi Incitae,
A declaration of trust could also impact upon who is liable to pay Capital Gains Tax in the event of a sale. With this in mind, it might be appropriate to remove the declaration of trust prior to sale so as to ensure both parties can fully use their CGT allowances.

In general, if you are UK resident, you would declare the foreign gains on your UK tax return and UK losses would be available to set against the gains. However, if you have claimed the remittance basis then you will need to consider the guidance here:

RE: 35 year query
Hi,
As you have been living and working abroad, you should read the leaflet NI38 which explains about paying for shortfalls in National Insurance whilst abroad. You can find this here:

If you then decide you wish to find out your shortfall years, you should complete and send the CF83 application form and tick the box for shortfall years info.
If you are applying for Class2 shortfall advice, please include a covering letter with your periods of employment and, or, self employment abroad. Although HMRC can advise what years you may be able to pay for, we cannot confirm if these will benefit your pension forecast. You will need to contact Future Pension Centre to discuss which years, if any, will be beneficial to pay to increase your basic State Pension.

RE: CF83 covering letter
Hi,
We are sorry that you have not received a reply yet to your CF83 application from November 2022. We are experiencing a high demand on this work and are currently dealing with applications from end of August 2022.
Unfortunately, although the form CF83 is available to download online, they are not yet available to submit online. HMRC is looking to have this form made available online in the future. In the meantime, if you want to check on progress to see if further information maybe required, you can contact our National Insurance team for non-UK residents
