CF83 - Class 2 NICs Rejection - Currently?
A client was recently rejected for Class 2 NICs. Has 10 years on her NI record. She worked abroad from 2006 until 2020. She has not worked since. Q - Must a person be currently employed abroad in order to get Class 2 from 2006 until they stopped working 4 years ago? My understanding is that she is eligible to pay Class 2 from 2006-2020 And then Class 3 from 2020 - now as not working abroad then. Q - Can you clarify this specific rule please? (rather than comment on the specifics of this person) Thanks -

I believe HMRC are obliged by law to say that she must pay the 10 years first and once payment for that has been made (where applicable), then call them again and they can reassess her for the additional years. Interesting Q though.... -
No Reply to CF83 but Can Pay Class 2 for 2023-2024?
2 clients who applied to pay Class 2 NICs via CF83 have not yet had any answer. However, they both separately just received a letter stating they could pay Class 2 for 2023-2024. 1 - Why would they each have got this letter recently if they had not yet got confirmation that they could pay Class 2 for past years? 2 - Is HMRC sending such letters - just for last year - as standard before sending a reply to the CF83 application given it's a new tax year? 3 - Should they wait for an answer to their CF83 application before doing anything / Is one coming? I'm helping someone do CF83 who worked in UK for 3+ years but they only ever had a Temporary National (TN) Insurance number. What extra info should they provide to ensure they're found by HMRC on the system or will there be any issues with just applying with a TN? Thanks -

Q - If a person has lived and worked (paying Nat Ins) in the UK for just 1 year followed immediately by 2 qualifying years of working/paying EU Social Insurance (as per NI38 guidance), how should one answer Q5 & Q6? ie: Will answering 'No' to Q5 & Q6 disqualify those who previously qualified for Class 2 as they paid EU social insurance? Q - If a person can not recall their National Insurance number, presumably their last 3 address and any additional employment details are still required to find them on your system as per NI38 Guidance? -
Appealing a CF83 Decision?
A relative has just been told she needs to pay Class 3 NICs following the assessment of her CF83. We've checked closely and believe she fits every Class 2 eligibility criteria with 8 years of Nat Ins paid in the 1990s having been ordinarily employed in UK immediately prior to leaving and then continuous work abroad since then paying EU social insurance (evidence provided to International CaseWorker) What steps can she take to appeal this decision? Is a Mandatory Reconsideration possible? -
