Declaration of Trust on foreign sole bank accounts
Hi, my wife and I are UK tax residents. I have a few foreign bank accounts in my sole name, but they are effectively held for the common benefit of me, my wife and our children. Can I make a declaration of trust in the UK on my foreign sole bank accounts, so that the interest income thereon are split 50/50 between my wife and me? If yes, can the effect also be retroactive, such that the interest income before the declaration can also be split 50/50? Thank you. -
Tax on dividends and "coupons" on foreign life insurance policies
Hi, I am UK tax resident. I have a life insurance policy in Hong Kong that pays an Annual Dividend and a "Coupon" once every two years. Assuming that the Coupon is in the nature of returning some of the premiums I have paid into the policy over the years, do I have to pay UK tax on the Coupon? If so, will the Coupon be classified as dividend in the self assessment form? Thank you. -

Hi, I would like to clarify the meaning of the following excerpt from the Income from land and property abroad in the self assessment form: "You cannot deduct: for more than one year, expenses incurred in connection with the first letting or subletting of a property. These include legal expenses such as: the cost of drawing up a lease, agents' and surveyors' fees, commission" I have a foreign rental property which I let out for two years. The real estate broker's commission for bringing me the tenant is $1,800. Can I deduct $900 (being one-half) in the first year of lease? Can I deduct the remaining one-half ($900) in the second year of lease? Thank you. -
Rental income of HK-incorporated limited liability company
Hi, my wife and I are UK tax residents. We jointly own a Hong Kong-incorporated limited liability company that owns a Hong Kong property producing rental income. In other words, the Hong Kong-incorporated company is the landlord in the tenancy agreement and, therefore, receives the rental income, not us. I suppose we (my wife and I) do not report such rental income in our UK tax returns, but we would appreciate your confirmation. Thank you. -

I have a foreign property that I previously lived in as my primary home but I have rented it out. Prior to renting it out, I lived in it and had and still have a mortgage loan that I used to purchase the property for self-use many years ago. My question is: is the interest on this mortgage loan tax deductible from the time I rented out the property? Thank you.
