RE: NI deduction query
Hi Prabhakar Golla,
We are unable to advise on your individual circumstances.
All liability requests on exemption of UK NICs depends on the country involved and or if there are any pre existing agreements between the posting country and the UK.
If you work and live in outside the UK you will need to contact your own authorities for a decision on whether you pay to them.
If they advise we need to make that decision you will need to make that request in writing.

We require this application even if you do not physically complete work in 2 or more countries, there is a provision within the application for your type of enquiry.

RE: Incapable of work, what is my class of NIC?
Hi wyllis Cheung,
If you are not receiving a benefit which has a credit awarded to maintain your National Insurance account for State Pension purposes, then you may pay voluntary Class 3 National Insurance contributions.
This would be for State Pension purposes only.
If you have access to your Personal Tax Account then you may wish to check this shortly after the tax year to see if a payment of voluntary class 3 contributions is required.

RE: Non -Qualifying NI year available but unable to increase state pension?
Hi MovingMike 1955,
Under the new State Pension the calculation is split into pre and post 2016 years.
There is a maximum number of pre-2016 years which can count towards your State Pension.
Once an individual has the maximum pre-2016 years paying any addition years before 2016 – in this case 15/16 – would not add a qualifying year and would not increase their overall State Pension award.

There is no difference in the State Pension that you will receive whether you pay Class 1, Class 2 or Class 3 National Insurance contributions.
The Pension Service will look at qualifying tax years when calculating your entitlement to your State Pension.

RE: postal address for sending CF83 form from overseas
Hi alicja b,
Sorry for the confusion with our postal addresses.
Basically, whichever address that you use will be fine.
The address with post code NE98 1ZZ is our physical address and is used for courier deliveries, whereas the address with post code BX9 1AN is used for normal mail from either in the UK or overseas.

RE: Working in UK as PAYE employee but living in Spain
Hi claudio
If you are resident in Spain, then you will need to approach the authorities in Spain regarding a liability decision.
Generally you pay National Insurance where you work.
When you work in more than one country, then the Social Security authorities in the country where you live need to make a determination of where you are liable to pay.
If they determine you should be paying in Spain, then they can provide you with an A1, exempting you from paying in the UK.
